Drink driving loophole closed
A loophole where drink drivers could pass a blood sample test has been closed
The loophole existed in situations where an offender could opt for a blood sample to be tested (this was called the statutory option) when a breath test was less than 40% over the legal drink drive limit. Due to the complexity it takes to organise a blood test, the offender could have fallen under the limit by the time the blood test was carried out.
