Defences

There are exceptions which mean it is permissible to stop, such as a breakdown, an accident, a sudden illness or needing to move an object that has fallen onto the road. You must, however, only stop for as long as is absolutely necessary and any longer will be committing the offence. If you face an allegation in relation to driving or stopping inappropriately on a motorway and you are unsure of your position, we advise you contact us to take specialist legal advice.
