Driving/Stopping on a Verge or Central Reservation

It is an offence to either drive or be stationary on the Central Reservation or Verge of a motorway.

The Verge of a motorway, is any part of it that is not either the carriageway (i.e. part of the road that is normally driven on) or the hard shoulder.

No, there is not a requirement for an NIP for offences relating to driving/stopping on the Verge or Central Reservation of a motorway.

Punishment

Fine up to £2,500, 3 penalty points and discretionary disqualification from driving.

Defences

There are exceptions which mean it is permissible to stop, such as a breakdown, an accident, a sudden illness or needing to move an object that has fallen onto the road. You must, however, only stop for as long as is absolutely necessary and any longer will be committing the offence.
